Selling Home Processes

When you are selling your home (Lot) within The HAMLETS community – the Virginia Property Owners Act (POA) requires the Association to prepare a Property Owner's Disclosure Packet. This disclosure package will be issued to the seller and/or their agent(s). This package is required by Virginia state law and the package is forwarded by the owner to the buyer and/or their agent(s). The Lot is the legal entity that is transferred between owners. The are 47 deeded  residential Lots in The HAMLETS community.

1. Preparation and Delivery of the Association’s Disclosure Packet: 

Upon a "written request" with delivery instructions to the Association by the seller or the seller’s authorized agent(s). The Association shall electronically deliver within 14 days after receipt an association disclosure packet as directed in the written request. When the package is electronically delivered, the written request is deemed received on the date of delivery. The information contained in the association disclosure packet shall be current as of the date requested and delivered in accordance with the written request and instructions of the seller or the seller’s authorized agent to the parties designated.

2. Cost of the Association’s Disclosure Packet:

There is a Fee of $200 (payable to the HOA) assessed to the Seller that can be remitted in advance or at settlement. If Lot ownership does not transfer at a settlement the fee will still be added to the Lot’s overall balance and due upon its next quarterly assessment after the Lot is removed from the market. The HAMLETS HOA can deliver “Expedited” electronic copies of the HOA POA disclosure package (as requested in writing), within 5-days for an additional $50.00 dollars fee. The HAMLETS HOA will deliver an additional “updated” POA disclosure package if needed (as also requested in writing), for an additional fee of $50.00 dollars per issuance.

3. Architectural Inspection of the Lot's Exterior and Additional Structures: 

The architectural inspection will be conducted by the HOA’s Architectural Review Board (ARB) or Board of Directors as authorized in the Association’s declaration and as required to prepare the Association’s property owner's disclosure packet. There will be no fee to the seller or the buyer. If there are any current or outstanding architectural violations they will be documented within the issued disclosure packet. If an additional external ARB inspection of the property is requested by either the Seller or Buyer there will be a fee of $50 dollars assessed at settlement to the requesting party.

4. Trash/Recycle Bin(s) are the Property of the Trash Vendor: 

During the transfer of the Lot the Seller is to clean and leave the bin(s) for the Buyer. If trash/recycle bin(s) are missing or not transferred from existing to new owner the cost of replacement is the responsibility of the New Lot owner. 5. The HAMLETS - Property Owner Association (POA):

It is the responsibility of each Lot owner to assist and ensure compliance pertaining to The HAMLETS HOA's Covenants, Rules and Regulations, and Assessments, as well as all applicable Prince William County and Virginia laws and regulations governing such things as noise levels, health and safety standards, pet laws, and building code requirements, etc. Refer to the following: Fee Schedule.
